They have been threatening to do it, and they have. s5 (j) of the act interpretation act has been repealed.
So fucking what you say... Well, given the way NZ law works, this is somewhat similar to the american constitution being rewritten to say *you have the right to shut the fuck up and do what you're told*
NZ does not have a constitution, we have a bill of rights ACT which is not entrenched and has a clause in it saying that it is to be read secondary to any other piece of legislation (i.e. it would serve more purpose in a bathroom than in a courtroom)... s5 (j) of the AIA said that whenever possible, anything that conflicted with the bill of rights act, was to be given its 'fair, large and liberal' meaning, so it functioned to ameliorate harsh or injust laws. Now we don't have it, and parliament can screw us until we think of a new option... My suggestion is to let RW loose in parliament for an hour or so with his choice of ammunition http://www.thehypertribe.net/ubb/wink.gif
And.... due to a recent court of appeal decision, in NZ, we can now use evidence of prior charges which resulted in AQUITAL http://www.thehypertribe.net/ubb/eek.gif
The implications of this are that, basically, if the police decide to screw you over, then they can charge you on seperate indictments, and keep the trials rolling, offering their own previous charges as evidence on the same incident, until a jury convicts....
So much for New Freeland...

I'll go out on a limb and say the people of NZ are not revolting for the same reason the Aussies let their guns be taken away and the americans accept Social Security and fed Tax.
It won't hurt the "good" people only the "BAD" people. Their gov't is protecting them. Making it safe to walk on the streets at night.
Our politicians just want us to be safe.
Last year in America crime was at an all time low.
Prison populations are at an all time high.
So if you arrest more people they commit less crime.
Hell if they'd arrested me I wouldn't be able to commit any crimes.
Of course that's not a problem for me because I'm too busy working, raising kids, etc. The only thing that seriously threatens me is haveing financial security in a country that takes 40% of what I make to give to other people 1000 miles away.
But I'll put up with it as long as they don't tell me what to think

Well, it is not really a matter of being allowed. In NZ, parliament is sovreign and can legislate whatever they damn well feel like so long as they get the Gov Generals consent (which s/he always gives.)

Actually, to further answer some of the questions raised, my personal belief is that this is being done to try to limit some of the precedents which have been set over the last few years regarding the Treaty of Waitangi.
The crown never intended to honour its obligations under the treaty, but judges have been using s5 to make sure they do. (For those of you not familiar with NZ issues, this has meant HUGE cash payments, handing back of land, handing over of fishing and forestry rights etc... all fair in my opinion).
Also, certain judges like (my hero) Sir Robin Cooke, have been using this piece of legislation to say 'well, parliament obviously did not mean to do something so injust (insert sarcasm here) so I will just read it in a different light'...effectively making the law up as they go along http://www.thehypertribe.net/ubb/biggrin.gif
So, I can see parliaments motivation... I just don't fucking like it.
Fortunately, you get pretty good at playing this game in law, and I don't think it will be too long before the judiciary comes up with some interesting 'interpretations' on the wording of new/other legislation in order to put parliament in its place (we call it 'word wanking')... I just hope that minimal damage is done in the mean time.

Kind of. In theory, yes. In practice, no.
Although we are part of the commonwealth, parliament is sovereign in NZ. Although the queen has the right to tell the GG not to assent to any bill, she never would by way of convention, and because she knows NZ would just leave the commonwealth if she did.
