Simple answer RW is that it will never get through the European Parliament or the Council of Ministers. So its a moot point really.
The European Commission (who I have no doubt came up with the idea) are merely a policy formulation body. In order to pass the legislation it first has to go to through the European Parliament scrutiny, which is dominated by the centre left, so it stands no chance. Then it has to go to the Council of Ministers (the relevant minister from each member state, in this case the Home Secretary/Interior Minister) which will vote on its passing. The buck stops with them. Now given that the vote needs to be unanimously carried, i'e everyone agrees and their are no dissenter, I doubt it will actually come to pass. Particularly given the attention it has received in the UK and France.
Personally I don't agree with it, and secondly I don;t expect it will ever make into European Law, given the fact that internal telecommunications is not currently covered as a trans european policy area under the principles of subsidiarity as outlined under the Single European Act of 1987.
